Terms and Conditions

These Terms of Use are in effect from 16/07/2024. 

Α. INTRODUCTION 

1. Who we are

1.1. The NBA Professional Skills Academy (the «Academy») was established by the National Betting Authority (“NBA” or “Authority”), which is responsible for its administration and operation.

1.2. The NBA is a regulatory body responsible for the licensing and supervision of betting activity in the Republic of Cyprus. It is governed by the Betting Law of 2019 and was established in 2012 as a Legal Entity of Public Law.

2.Terms of use

2.1. By registering on the Platform through the website www.psacademy.cy (the “Website”), you are deemed to have understood and accepted our “Terms and Conditions”, which constitute a binding agreement between you and us and include (i) the present Terms of Use, (ii) the Privacy Policy and (iii) the Cookies Policy.

2.2. Please read the Terms and Conditions carefully before registering on the Academy. 

2.3. If you do not accept the Terms and Conditions, do not register or use the Website.

2.4 Any reference to “Training Material” in our Terms and Conditions is a reference to the trainings and any other material accompanying them, regardless of the manner or method of dissemination.

3. Changes to the Terms and Conditions

3.1. We may unilaterally revise our Terms and Conditions from time to time for various reasons, including compliance with all relevant laws and regulations.

3.2. The most recently updated Terms and Conditions will be available on the Website. It is your responsibility to check these Terms and Conditions each time you visit the Website or use the services of the Academy, so that you are informed of any modifications, as the applicable Terms and Conditions are binding on you.

Β. ACCOUNT AND TRAINING

1. Registration

1.1 Although you can access certain sections of the Website without registering, in order to be able to use the services offered by the Academy and have access to the Training Material, you must first register as a user of the Academy.

1.2 Registrations are made only through the online form on the Website, in which you must fill in the following information:

• Name,
• Surname,
• Email address.

For email address verification purposes you will receive a link at the email address you specified, which you must follow to activate your account. Subsequently, during your first login to the Academy as a registered user, you will be asked to specify a second method of identity verification for the purpose of logging into your account (2-factor authentication code).

1.3 Any account registration by telephone or e-mail is not permitted.

2. Training purchases

2.1 All purchases are made exclusively through the Academy and only by registered users.

2.2 The participation fee for each training is included in its description.

2.3 For each of your purchases, you can request that a receipt or invoice be issued, either to you or to a third party.

2.4 Completion of your purchase will be validated by the Academy within three working days of making the relevant payment.

3. Access credentials to the Training material

3.1 Upon completion of your first purchase, you will be sent your personal access information to the Moodle learning management system, with which the Academy cooperates and through which you will have access to the Training Material.

3.2 Your login details will apply to all following purchases through the Academy.

4. Availability of Training Material

4.1 Each live training (and any other training materials accompanying them) will be available after completion of your purchase, for a period of one month after the end of the training, if it is only one session, or the last training, if it is more than one training sessions.

4.2 Each Asynchronous E-Learning course will be available for a period not exceeding three months from the date of completion of the relevant purchase.

4.3 NBA reserves the right, at any time and for any reason:

• to postpone and/or reschedule any training or series of trainings;
• to modify the manner or method of dissemination of any training or series of trainings.

5. Certificate of Completion

The successful completion of the training course results in the award of a Certificate of Completion, co-signed by NBA and the Training and Development Unit of the University of Nicosia.

The Certificate of Completion is granted with the understanding that the participant has attended at least 75% of the training course.

6. Replacement of person

You can only transfer a specific purchase to another person if –

• is a registered user of the Academy and
• you have notified the Authority at least three working days before the start of the relevant training.

7. Cancellation

7.1 You can cancel your purchase, only if (a) it is a training that is provided by the “Live training” method and if (b) you inform the NBA via email at [email protected], at least three working days before the scheduled training date.

7.2 In the event that the start of training, which is provided by the “Live training” method, is postponed to a later date, you can cancel your purchase by email at [email protected], up to three working days before its new scheduled date.

7.3 In the event that training, which is provided using the “Live training” method, is canceled for any reason, either before the start of the training or at any point before the completion of the training sessions (if it is a series of training dates), then your purchase will be automatically canceled by the NBA.

7.4 In any event, if you cancel your purchase or it is canceled for any reason by the NBA, the Authority will refund you the full amount you paid in relation to it.

7.5 All refunds are made to the account from which the relevant purchases were made.

C. YOUR PERSONAL DATA

1. You will provide the ΝΒΑ with all personal data requested during your registration on the Academy and during the transaction payment stage. You can also provide us with personal data when you contact the NBA Contact Center at +357 22881800 or via email at [email protected].
2. You agree that the NBA may process any personal data relating to you, whether collected during registration or within the account on the Platform or otherwise directly from you, to the extent necessary to fulfill NBA’s obligations under the Terms and Conditions.
3. You agree that we may share with and/or receive personal data relating to you with EDEX – Educational Excellence Corporation LTD (University of Nicosia) and Moodle Pty Ltd, who are working with us for the implementation of the Academy, where necessary, for the performance of these Terms and Conditions.
4. It is provided that the collection, processing and retention of any form of personal data concerning you or related to you will be done by us lawfully in accordance with and in compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of the 27 of April 2016 (General Data Protection Regulation) and the relevant personal data protection legislation in force in the Republic of Cyprus.
5. Information about how your personal data is processed (and for verification purposes), is set out in our Privacy Policy.

D. YOUR RESPONSIBILITY

1. Introduction

You understand that the Training Materials are not infallible and may include elements, information and data that are incomplete, inaccurate and/or incorrect. The Training Material is offered as an aid in relation to matters relating to the gambling sector and matters ancillary thereto and is in no way a substitute for legal advice. The NBA does not guarantee the correctness of the Training Material and therefore does not bear any responsibility for any claims of a legal, civil or criminal nature nor for any damage and/or loss resulting from actions or not arising from this material.

2. Accuracy of information and security

2.1 You agree that you will provide true, accurate and up-to-date information when registering with the Academy and understand that any certificate and/or certification of CPD (Continuing Professional Development) credits you may be awarded will bear the information you submitted to the Academy.

2.2 DO NOT TRY TO REGISTER WITH ANYONE ELSE’S INFORMATION. 

Registering an account on the Platform with data or on behalf of another person constitutes a violation of the Terms and may expose you to legal liability towards us and against the person whose data you have used or on whose behalf you have registered.

2.3 If you wish to modify or update any of your personal account information (for example, if you change your name or email address), please contact the NBA Contact Center. 

3. Your responsibility for your account   

3.1 You are responsible for maintaining the confidentiality of any information that is part of your registration on the Academy. The Authority takes all reasonable measures to protect your personal data and information obtained through your use of the Academy. However, the Authority is not responsible in any way and to any extent for any leakage of your personal data as a result of illegal actions of third parties, who are not related to the Authority and who gain access to the files of the Platform and/or the Website without the NBA’s authorization. 

3.2 You must notify us immediately of any unauthorized use of your account or any other breach that may affect the security of the Academy or your account. We are not liable for any loss or damage that may arise from your disclosure of your account details.

4. Acceptable use

4.1 You may access our Website only for lawful purposes.

4.2 You are not allowed not misuse the Website by uploading viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. In particular, but not limited to, you may not: access without authorization, interfere with, damage or disrupt the Website or any part thereof, any equipment or network on which the Website is stored, any software used in connection with the provision of the Website, or any equipment, software or website owned or used by a third party. You are not allowed to  attack the Website through a “denial-of-service” attack. 

5. Linking to our Website   

5.1 Providing or including a link on a website owned or operated by you to the Website is permitted only provided that you do so in a manner that is fair and legal and does not damage or take advantage of the reputation of either the NBA or the Academy. You must not provide links to our Website in such a way as to suggest any form of association or endorsement by us where none exists.

5.2 Our Website must not be framed on any other website.

5.2 The NBA may at any time and without justification require you to remove such a link from the website owned or operated by you.

Ε. LIMITATION OF LIABILITY

1. Availability

1.1 The Website and the Academy are provided “as is” without warranties of any kind. We make no representations or warranties of any kind regarding the availability or operation of the Website or the availability of the Training Material or that access will be secure, uninterrupted or error-free.

1.2 Your access to the Website, the Academy and the Training Material may be suspended or restricted from time to time for purposes of maintenance, repairs, upgrades or integration of new equipment or services. We will always try to limit the frequency and duration of any planned or unsuspended service interruptions, but we will not be liable to you if for any reason the Website and/or Training Material is unavailable at any time and for any period of time, including where self-exclusion delay longer than the intended time either to activate or deactivate. The NBA reserves the right to make changes or corrections or modifications, interrupt or discontinue any aspect of the Website, the Academy or the Training Material and the content or services available through it, including your access to it.

2. Computer viruses

The software of the Website is provided “as is” without any warranties, conditions, commitments or representations, express or implied, statutory or otherwise. The NBA hereby excludes all implied terms, conditions and guarantees. The NBA makes reasonable efforts to ensure that the Website’s software and servers do not contain or propagate viruses or other malicious code. The NBA shall not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or downloading of any material posted on it, or on any website linked to it.

3. General

3.1. Unless otherwise stated in these Terms and Conditions, the NBA does not accept any legal responsibility or liability for any harm, (physical or psychological), financial damage or loss that is or is perceived to have occurred in connection with the Website or the Training Material  or the services it offers through the Academy (including, but not limited to, delays or interruptions in operation or transmission, loss or corruption of data, failure of communications or lines, failure to failure to connect to Live or Asynchronous E-Learning, imposition of an administrative fine or criminal liability, misuse of the Website, Academy and Training Materials or their contents by any person, any errors or omissions in their content).

3.2. We shall not be liable to you for any loss or damage arising from or in connection with:

• your access or failure to access the Website and related Academy services and Training Material;
• your ability or inability to purchase or cancel a training;

• administrative sanctions or warnings from a competent regulator due to incomplete, inaccurate or incorrect data, information or data in Training Materials,
• administrative sanctions or warnings from a competent regulator due to the cancellation or postponement of Training Material or its transfer to a later date,
• criminal liability due to incomplete, inaccurate or incorrect data, information or data in Training Materials,
• loss of reputation due to incomplete, inaccurate or incorrect information, information or data in Training Materials.

In particular, but not limited to, we are not liable to you for: 

• any loss and/or damage and/or loss of opportunity and/or income arising as a result of your failure to access Training Materials;
• any loss and/or damage and/or loss of opportunity and/or income arising as a result of incomplete, inaccurate or incorrect details, information and data in your account with the Academy.
• any loss and/or damage and/or loss of opportunity and/or income arising as a result of incomplete, inaccurate or incorrect information, information and data in the Training Material.

F. TERMINATION 

1. We may terminate your account and your access to the Academy without notice if you violate these Terms and Conditions or if we believe in our sole discretion that your use of our Website or Academy is inappropriate in any way.
2. You may terminate this Agreement and close your relevant account at any time by contacting us using the information in Chapter I of these Terms of Use.

G. INTELLECTUAL PROPOERTY 

1. You agree that no part of the Website, Academy and Training Material may be reproduced or stored, converted, copied, republished, uploaded, posted, transmitted or distributed, in any manner or medium, or included in any other website or other public or private system; or electronic retrieval service including text, graphics, video, messages, codes and/or software without our express written consent.
2. Any commercial use or exploitation of the Website or Academy or its content is strictly prohibited.
3. Any commercial use or exploitation of the Training Material is strictly prohibited.

H. OTHER IMPORTANT TERMS 

1. These Terms of Use, Privacy Policy and Cookies Policy are the Terms and Conditions and constitute the entire agreement between the Academy and you and supersede any prior agreement between us on this subject matter. You acknowledge and agree that by accepting these Terms and Conditions, you are not relying on – and will waive any right of recourse with respect to – any statement, representation, warranty, agreement, promise or assurance (whether made negligently or naively) of any person other than those set out in these Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud or fraudulent misrepresentation.
2. In no event shall any delay, failure or omission (in whole or in part) in enforcing, exercising or prosecuting any right, power, privilege, demand or remedy granted or arising under these Terms and Conditions or by law, or shall be construed as a waiver of such or any other right, power, privilege, demand or remedy under the particular circumstances, and shall not operate so as to prevent the enforcement of such or any other right, power, privilege, demand or remedy, in any other occasion for any time or times thereafter.
3. The NBA shall not be liable for any delay in the performance of, or failure to perform, any of its obligations if such delay or failure arises from events, circumstances or causes beyond its reasonable control, including (without limitation) any telecommunications network failures, power failures, third-party computer hardware or software failures, fire, lightning, explosion, flood, bad weather, industrial disputes or lock-outs, acts of terrorism and acts of government or other competent authorities. In such cases, the performance time will be extended by a period equal to that during which the performance of the obligation has been delayed or failed.
4. These Terms and Conditions are governed by the laws of the Republic of Cyprus, where the courts of the Republic shall have exclusive jurisdiction over any disputes relating to these Terms and Conditions.
